Addendum
SERVICE ADDENDUM: WEBSITE DESIGN & DEVELOPMENT SERVICES

This Addendum is incorporated into and forms an inseparable part of the Master Terms and Conditions of Olivier Digital Studio (Pty) Ltd.

Wix Infrastructure Dependency: All website design and development services are executed exclusively within the Wix platform ecosystem. The Client explicitly acknowledges that the website’s architectural stability, operational logic, database hosting, and layout behaviors are fundamentally dependent on Wix’s global cloud servers.

Exclusion of Platform Errors: Olivier Digital Studio (Pty) Ltd operates as an independent design agency and Wix Icon Partner. The Company cannot be held legally liable, financially responsible, or in breach of contract for platform-wide outages, server downtime, core software bugs, or sudden changes to the Wix Application Programming Interface (API) that alter site layout rules or native app functionalities.

Exclusion of Subscriptions: All digital labor quoted by the Company covers professional assembly, custom design, and technical configuration only. The procurement and continuous funding of Wix Premium Plans, Domain Registrations, SSL Certificates, and Google Workspace accounts remain the exclusive financial responsibility of the Client.

The 5-Day Asset Window: To prevent project stagnation and guarantee development timelines, the Client must supply all required brand assets, high-resolution media (PNG/SVG logos), professional photography, copywriting, and third-party login access details within 5 business days of the commencement deposit clearing.

Content Adequacy: The Company is not responsible for the quality, resolution, or grammatical accuracy of client-supplied assets or text. Delay in delivering content does not pause or alter invoice due dates.

Project Archival & Stalling Clause: If a design project is stalled, delayed, or unprogressive for more than 14 consecutive calendar days due to a lack of Client input, unprovided materials, or delayed feedback, the project will be automatically archived. To reactivate an archived project, a mandatory reactivation fee of 15% of the total project value will apply. The Company reserves the right to immediately invoice for 100% of the work completed to date upon project archiving.

E-Commerce & Online Stores:

Inventory & Pricing: The Client is entirely responsible for the factual accuracy of product listings, pricing matrices, inventory syncing, and tax structures.​

Payment Gateway Liability: The Company integrates third-party payment gateways (e.g., PayFast, Yoco, PayPal, Peach Payments) via standard Wix APIs. The Company is not liable for failed transactions, security breaches on the gateway provider’s end, payout delays, or fraudulent charges.

Accommodation & Booking Platforms:

Double-Bookings & Channel Syncing: The Company configures Wix Hotels or native booking calendars based on Client parameters. The Company accepts zero liability for booking overlaps, calendar syncing dropouts with external channels (e.g., Booking.com, Airbnb), or lost accommodation revenue.​

Restaurants & Food Ordering:

Order Failures: The Client must monitor their live Wix Restaurants dashboard. The Company is not liable for unfulfilled orders, delivery radius calculation glitches, or customer disputes regarding real-time order completions.​

Events, Weddings, & Ticketing:

RSVP & Ticket Glitches: For event and wedding sites, the Company sets up registration forms and digital ticketing mechanisms. The Company is not liable if guests fail to register, if notification emails land in spam filters, or for ticketing software anomalies during high-traffic intervals.​

Portfolios & Basic Business Profiles:

Lead Generation: While the Company sets up contact forms and optimizes workflows, we provide no guarantee of lead volume, commercial inquiries, or specific conversion metrics.​

Regulatory Frameworks: The Company will build integrated fields for Privacy Policies, Terms of Use, and Cookie Consent banners as requested by the Client. However, the Client bears ultimate legal accountability for ensuring their business operations, customer data collection, and processing methods comply with South Africa’s Protection of Personal Information Act (POPIA).

Legal Content Vetting: The Company does not provide legal counsel. It is the Client’s responsibility to have their industry-specific terms, cancellation policies, and refund rules legally vetted before handing them to the Company for website publication.

The Revisions Boundary: Project quotes include a designated "Review & Revisions" phase as outlined in the project milestones. Revisions must be submitted as a single, compiled list of reasonable structural adjustments that align with the original onboarding brief. Requests that veer outside the initial brief will be treated as a "Scope Change" and billed at our current hourly studio rate.

The Final Payment Gate: The remaining 50% balance must clear in the Company's bank account prior to live domain connection, SEO index triggering, or transferring ownership of the Wix digital workspace to the Client.

The Post-Launch Warranty Window: Upon site handover or live connection, a strict 14-calendar-day technical warranty window commences. During these 14 days, the Company will fix any backend bugs, broken links, or configuration issues within the original scope free of charge. After day 14, all technical support, updates, or modifications will be billed at the Company's hourly rate or will require enrollment in an active Website Maintenance Retainer.
